Girl Talk All Day shoves the bounds of trying

Pittsburgh-based DJ Girl Talk has launched his second album, “All Day”. The DJ mix record uses almost 375 music samples. All together, they create a 71 minute piece of music. Girl Talk “All Day” is being launched totally free and will likely spark further discussion of the legality of testing.

Greg Gillis is DJ and performer Girl Talk. A second album was launched by him. In 2008, he launched his first record while since then more than 40 tour dates a year have been scheduled. You can get a totally free download on the Illegal Art website. It is the "All Day" album. "All Day" by Girl Talk is intended to be a long listening piece that is 71 minutes long although it’s split into 12 tracks. There are about 373 different samples, or pieces of songs, from artists on the record.

The legal issues of testing for ‘All Day’

The Girl Talk “All Day” album might pose a challenge for the legitimacy of sampling. In general, with permission, testing of music for a new piece is allowed. That permission isn’t always obtained, however, and the “fair use” of music samples has been a frustrating issue for the courts. Recently there was a decision made with Bridgeport Music Inc. v. Dimension Films. This decision said that a "distinctive" three note riff is enough if permission wasn't requested to be considered a violation.

'All Day' by Girl Talk and the way Creative Common license applies

The Creative Common permit is getting used increasingly more with the all-or-nothing copyright option being taken. This is a “claim and release” system of copyrighting that allows artists to allow some kind of use of their work, with attribution, remixing and commercial use as they dictate. The Girl Talk “All Day” album is released under a Creative Commons non-commercial permit. As long as there aren't any commercial reasons for the work being used, it can be used by anybody. While Girl Talk may well benefit from the exposure this brings, there’s a concern of whether all the artists included in the samples can be — or need to be — remunerated for their sampled work.
